Dispute avoidance is usually always preferable to dispute resolution. Our early involvement can substantially reduce the incidence of disputes. We undertake detailed reviews to address respective responsibilities, obligations and highlight onerous clauses; identify contractual risk and assist in establishing procedures to manage it. We also develop and assist in the implementation of early warning notices and systems of record keeping, training staff as required in order to ensure that the chances of a dispute occurring is minimised as far as possible.
The Pre-Action Protocol under the Civil Procedure Rules encourages the parties to a dispute to try and resolve matters before getting to court; mediation can be an effective way of achieving this. We can assist in the preparation and submission of documentation for mediations and/or conciliations; we also offer management support and attendance throughout the process.
